By visiting the website or registering as an advertiser, you agree to these Terms and Conditions. We advise you to read these General Terms and Conditions carefully.
1. Copyright
The advertiser guarantees that he owns the copyright of the photo and text material that he supplies to “Top-vak” (the material) or that he has received permission from the copyright owner to allow “Top-vak” to use the material. The advertiser grants “Top-vak” a permanent license to use the material for commercial purposes, without having to pay royalties. The advertiser must immediately indemnify “Top-vak” against any expenses, loss or liability (including legal representation expenses) incurred by “Top-vak” resulting from any copyright infringement arising from the use of the material. The advertiser is aware that photo or text material from any part of “this website” may not be reproduced without the permission of the copyright owner.
2. Design and layout
“Top-vak” reserves the right to determine the final design of the advertisements on “this website”, to edit the texts and to adjust layouts or photos. “Top-vak” also reserves the right to adjust and edit text data in the online advertiser database.
3. Liability
In the event that an advertiser is the victim of fraud, “Top-vak” is not liable. “Top-vak” does not guarantee that “this website” will function uninterruptedly or error-free. “Top-vak” is not liable to the advertiser for any fraudulent, direct or indirect damage, including loss of profit, howsoever caused, based on any liability theory and including but not limited to product liability.
4. Termination of a Listing
If “Top-vak” receives complaints from users about certain advertisements that misrepresent a property or its environment, we reserve the right to remove these advertisements without any notice or refund. If an advertiser attempts to enter inappropriate material into the database or repeatedly misuses the online system, “Top-vak” reserves the right to refuse any further advertising, without being liable for any possible expenses. Advertisers can have their advertisement removed from “this website” before the end of their subscription, subject to a formal request by email. Unfortunately no refunds can be made.
5. Contact
To ensure a high level of service, all advertisers of “this website” are requested to be available to answer requests by telephone or email. In the event that advertisers are unavailable for more than a week, we ask them to leave a message on their answering machine or set an automatic out-of-office message in their email account. If none of these options are possible, we ask advertisers to contact us so that we can temporarily suspend their advertisement. We reserve the right to suspend listings from owners who are unavailable for more than a week. We will then ask them by telephone and email to request reactivation when they are available again.
6. Payment Policy
Payment must be made within 14 days of registering a new property on “this website”. All prices stated are exclusive of VAT. Entrepreneurs in the EU outside Belgium who are subject to VAT are exempt from VAT in Belgium (art. 21 §3 7°).
7. Termination
A subscription (annual subscription) is tacitly renewed. If you want to cancel your subscription, you must do so before the year is over, i.e. before you receive a new invoice.
8. Refund policy
"Top-vak" provides an advertising service and not a physical product. We do not offer refunds or reimbursement for listings that may or may not have expired.
9. Changes in prices and conditions
“Top-vak” reserves the right to change prices and conditions without prior notice. Changes to pricing will apply immediately to new advertisers and at the next renewal to existing customers.
10. Title deed or mandate
The advertiser declares that it has a title deed or mandate for each advertisement.
11. Telephone contact with advertiser or help center on this website.
“Top-vak” is not responsible for any additional telephone costs you incur to an advertiser or helpdesk number on "this website". These costs depend on your own network provider.
12. GDPR: General Data Protection Regulation: GDPR legislation in force from May 25, 2018:
The information that you as an advertiser place on "this website" will never be passed on by “Top-vak” to third parties such as marketing companies or the like. We only use your personal data to manage your account and to carry out and deliver the orders you have entrusted to us.
13. LINKS TO OTHER WEBSITES
This website contains hyperlinks to other websites which may be owned and/or operated by third parties. "Top-vak" has no control over this. "Top-vak is therefore not responsible for and accepts no liability whatsoever for the accuracy, completeness and timeliness of (the content of) these websites, nor for their availability, nor for the fact whether the information made available by or through these websites can be used legally. The information on third-party websites to which links can be made is not part of the information made available by "Top-vak". The information on third-party websites to which links can be linked is therefore not part of any agreement between buyers and "Top-vak".
